The protection of your personal data is important to us. 1.1 In accordance with Article 13 GDPR, we inform you about the legal basis of our data processing. Unless the legal basis in the data protection declaration is mentioned, the following applies: The legal basis for obtaining consent is Article 6 (1) lit. a and Article 7 GDPR, the legal basis for the processing for the performance of our services and the execution of contractual measures as well as the response to inquiries is Article 6 (1) lit. b GDPR, the legal basis for processing in order to fulfill our legal obligations is Article 6 (1) lit. c GDPR, and the legal basis for processing in order to safeguard our legitimate interests is Article 6 (1) lit. f GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6 paragraph 1 lit. d GDPR is used as legal basis.
2. Changes and Updates to the Privacy Policy
2.1 We ask you to inform yourself regularly about the content of our privacy policy. We will adjust the privacy policy as soon as changes in the data processing we carry out make this necessary. We will notify you as soon as the changes require your participation (e.g. consent) or other individual notification.
3. Safety Measures
3.1 We take appropriate technical measures in accordance with Article 32 GDPR, taking into account the state of technology, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different likelihood and severity of the risk to the rights and freedoms of persons and organizational measures to ensure a level of protection appropriate to the risk. Measures include, in particular, ensuring the confidentiality, integrity and availability of data by controlling physical access to the data, as well as its access, input, disclosure, availability and separation. In addition, we have established procedures that ensure the realization of data subject rights, data erasure and data vulnerability. Furthermore, we consider the protection of personal data already in the development, or selection of hardware, software and procedures, according to the principle of data protection by technology design and by privacy-friendly default settings taken into account (Article 25 GDPR).
3.2 The security measures include in particular the encrypted transmission of data between your browser and our server.
4. Collaboration with processors and third parties
4.1 In the context of our processing, if we disclose data to other persons and companies (contract processors or third parties), transmit data to them or otherwise grant access to data, this will only be done on the basis of legal permission (e.g. if a transmission of data to third parties, as required by payment service providers, pursuant to Art. 6 (1) (b) GDPR in order to fulfill a contract), you have consented to a legal obligation or based on our legitimate interests (e.g. the use of agents, web hosters, etc.).
4.2 If we commission third parties to process data on the basis of a so-called contract processing, this is done on the basis of Article 28 GDPR.
5. Transfers to Third Party Countries
5.1 If we process data in a third party country (i.e. outside the European Union (EU) or the European Economic Area (EEA)) or if this is done in the context of the use of third-party services or disclosure or transfer of data to third parties, this will only occur if it is done to fulfill our (pre)contractual obligations, on the basis of your consent, on the basis of a legal obligation or on the basis of our legitimate interests. Subject to legal or contractual permissions, we process or allow the data to be processed in a third country only if the special requirements of Article 44 et seq. of the German Data Protection Act are met. This means that the processing take place, for example, on the basis of specific guarantees, such as the officially-recognized determination of a data protection level corresponding to the EU (e.g. for the U.S. by the “Privacy Shield”) or compliance with officially recognized special contractual obligations (so-called “standard contractual clauses”).

6.1 You have the right to ask for confirmation as to whether the data in question is being processed and for information about this data as well as for further information and a copy of the data in accordance with Article 15 GDPR. 6.2 According to Article 16 GDPR, you have the right to demand the completion of data concerning you or the correction of incorrect data concerning you.
6.3 In accordance with Article 17 GDPR, you have the right to demand your data to be deleted immediately or, alternatively, to require a restriction of the processing of data in accordance with Article 18 GDPR.
6.4 You have the right to demand that data relating to you, which you have provided to us, be sent to you in accordance with Article 20 GDPR. You have the right to request your data from other persons responsible. You may decline to share certain personal data with us, in which case we may not be able to provide to you some of the features and functionality of the online offer.
6.5 According to Article 77 GDPR, you have the right to lodge a complaint with data protection authorities.
7. Right of Withdrawal
7.1 According to Article 7(3) GDPR, you have the right to easily revoke your consent at any time.
8. Right to Object
8.1 According to Article 21 GDPR, you may object at any time to future processing of your data. In particular, you may object to the processing of your data for the purposes of direct marketing.
9. “Automatically Collected” Information and Right to Object to Direct Marketing Purposes
9.1 When a user or visitor uses the service, we may automatically record certain information from the user’s or visitor’s device by deploying temporary and/or permanent cookies. Cookies are small files that are stored on users’ devices (for an explanation of the term and function, see the last section of this Privacy Policy). In part, cookies are used for security or to operate our online offer (for example, for the presentation of the website) or to save the user’s decision when confirming the cookie banner. In addition, we or our technology partners use cookies for measuring reach and for marketing purposes, which users are informed about in the course of the privacy policy.

10. Right to Erasure
10.1 The data processed by us will be deleted or their processing restricted in accordance with Articles 17 and 18 GDPR. Unless expressly stated in this privacy policy, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and there are no legal obligations to retain them. If the data are not deleted because they are required for other and legally permissible purposes, their processing will be restricted. This means that data will be blocked and not processed for other purposes. This applies, for example, to data that must be stored for commercial or tax reasons.
10.2 For Germany: According to legal requirements, the storage takes place in particular for 6 years according to § 257 paragraph 1 HGB (trading books, inventories, opening balance sheets, annual accounts, trade letters, accounting documents, etc.) and for 10 years in accordance with § 147 Abs. 1 AO (books, records , Management reports, accounting documents, trade and business letters, documents relevant to taxation, etc.).
11. Provision of Contractual Services
11.1 We process inventory data (e.g., names and addresses as well as contact information of users), contract data (e.g., services used, names of contacts, payment information) for the purpose of fulfilling our contractual obligations and services in accordance with Article 6(1) GDPR. The entries marked as obligatory in online forms are required for the conclusion of the contract.
11.2 Users of Meister Cody – Testcenter can optionally create a user account to access their test center orders. Users of Meister Cody – School can optionally create a user account to add children to their account or manage their children’s training program. During the registration process, necessary mandatory information will be properly marked, usually with a * symbol, for the users. User accounts are not public and cannot be indexed by search engines. If users have terminated their user account, their data will be deleted with regard to the user account, subject to its retention for commercial or tax reasons pursuant to Art. 6 para. 1 lit. c DSGVO. It is the responsibility of the users to secure their data before the end of the contract in the event of termination. We are entitled to irretrievably delete all user data stored during the term of the contract.
11.3 As part of (re-)registration and and use of our online services, we will store the IP address and the time of each user action. The storage is based on our legitimate interests, as well as the user’s protection against misuse and other unauthorized use. This data will not be passed on to third parties unless it is necessary to pursue our claims or there is a legal obligation to do so pursuant to Article 6(1) GDPR.
11.4 We process usage data (e.g., the visited web pages of our online offering, interest in our products) and content data (e.g., entries in the contact form or user profile) for advertising purposes in a user profile in order to inform the user, e.g. to display product instructions based on their previously-used services.
11.5 Deletion takes place after expiration of legal warranty and comparable obligations. The necessity of keeping the data is checked every three years; in the case of legal archiving obligations, the deletion takes place after its expiration (end of commercial law (6 years) and tax law (10 years) retention obligation); Information in the customer account remains until its deletion.
12. How to Contact Us
12.1 When contacting us (via contact form, e-mail: team@meistercody.com or telephone +49 211 730 635 11), the information provided by the user to process the contact request and its processing are processed in accordance to Article 6(1) GDPR.
12.2 User information may be stored in our customer relationship management system (CRM System) or similar management system.
12.3 We use the CRM System „Zendesk“, offered by Zendesk, 1019 Market Street, San Francisco, CA 94103, USA) based on legitimate interests (efficient and fast processing of user requests). For this purpose, we have a contract with Zendesk with standard contractual clauses, in which Zendesk commits itself to processing user data only in accordance with our instructions and compliance with EU data protection standards. Zendesk is also certified under the Privacy Shield Agreement, providing an additional guarantee to comply with European privacy legislation. We use the CRM System „Pipedrive OÜ“, offered by Pipedrive, 460 Park Avenue South, New York, NY 10016, USA) based on legitimate interests (efficient and fast processing of user requests). For this purpose, we have a contract with Pipedrive with standard contractual clauses, in which Pipedrive commits itself to processing user data only in accordance with our instructions and compliance with EU data protection standards. Pipedrive also states on their privacy website that they are certified under the Privacy Shield Agreement, providing an additional guarantee to comply with European privacy legislation (https://www.privacyshield.gov/participant?id=a2zt0000000KzX1AAK&status=Active).
12.4 We delete the customer support questions, if they are no longer required. We check the necessity every two years; Inquiries from customers who have a customer account, we store permanently and refer to the deletion on the details of the customer account. In the case of legal archiving obligations, the deletion takes place after its expiration (end of commercial law (6 years) and tax law (10 years) retention obligation).
13. Comments and Posts
13.1. If users leave comments or other contributions/posts, their IP addresses are based on our legitimate interests within the meaning of Article 6(1) GDPR and saved for 7 days.
13.2 This is for our own safety, for example, if someone leaves illegal content in comments and contributions/posts (insults, prohibited political propaganda, etc.), we ourselves could potentially be prosecuted for the comment or post and are therefore interested in the identity of the author.
14. Collection of Access Data and Log Files
14.1 Based on our legitimate interests within the meaning of Article 6(1) GDPR Data, we collect data on every access to the server on which our service is located (so-called server log files). The access data includes the name of the retrieved web page, file, date and time of retrieval, amount of data transferred, message about successful retrieval, browser type and version, the user’s operating system, referrer URL (the previously visited page), IP address and the requesting provider. When using the app, server log files are also created, which contain date and time, API endpoint, request to the server (all user data is masked), feedback from the server (all user data is masked) and database actions. Logfile information is stored for security purposes (for example, to investigate abusive or fraudulent activities) for a maximum of seven days and then deleted. Data whose further retention is required for evidential purposes shall be exempted from the cancellation until final clarification of the incident.
15. Online Presence on Social Media
15.1 We maintain an online presence within social media networks and platforms in order to communicate with customers, prospects and users who are active there and to inform them about our services. By using the respective networks and platforms, the terms and conditions and the data processing guidelines apply to their respective operators.
15.2 Unless otherwise stated in our Privacy Policy, users’ data will be processed if they communicate with us on social networks and platforms, e.g. writing posts on our social media or sending us messages via social media.
16. Cookies & Audience Reach
16.1 Cookies are information transmitted from our web server or third-party web servers to users’ web browsers and stored there for later retrieval. Cookies can be small files or other types of information storage.
16.2 We use “session cookies” that are only stored for the duration of the current visit to our online presence (for example, to enable the storage of your login status or the shopping cart function and thus the use of our online offer at all). In a session cookie, a randomly generated unique identification number is stored, a so-called session ID. In addition, a cookie contains information about its origin and the retention period. These cookies can not save any other data. Session cookies will be deleted if you have finished using our online offer and you for example log out or close the browser.
16.3 The use of cookies in the context of pseudonymous range measurement informs users in the context of this privacy policy.

17. Google Analytics
17.1 Based on our legitimate interests (i.e., interest in the analysis, optimization, and economic operation of our online offer within the meaning of Article 6(1) GDPR), Google Analytics uses a web analytics service provided by Google LLC (“Google”). Google uses cookies. The information generated by the cookie about the use of the online offer by the users are usually transmitted to a Google server in the USA and stored there.
17.2 Google is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
17.3 Google will use this information on our behalf to evaluate the use of our online offer by users, to compile reports on the activities within this online offer and to provide us with further services related to the use of this online offer and the internet usage. In this case, pseudonymous usage profiles of the users can be created from the processed data.
17.4 We use Google Analytics to display advertisements displayed within Google and its affiliate advertising services, only those users who have shown an interest in our online offering or who have certain characteristics (e.g. interests in specific topics or products visited by them) Web pages) that we submit to Google (so-called “remarketing” or “Google Analytics audiences”). With Remarketing Audiences, we also want to make sure that our ads are in line with the potential interest of users and are not annoying.
17.5 We only use Google Analytics with activated IP anonymization. This means that the IP address of the users will be shortened by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be sent to a Google server in the US and shortened there.
17.6 The IP address submitted by the user’s browser will not be merged with other data provided by Google. 18. Google (Re-)Marketing Services
18.1 We may use the marketing and remarketing services on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Article 6(1) GDPR) (short „Google Marketing Services”) at Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, („Google“).
18.2 Google is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).
18.3 Google Marketing Services allows us to better target advertisements for and on our website so that we only present ads to users that potentially match their interests. Showing ads for products he’s been interested in on other websites is called remarketing. For these purposes, when Google and our other websites accessing Google Marketing Services are directly accessed by Google, a code will be executed by Google and so-called (re) marketing tags (invisible graphics or code, also called “Web Beacons “) incorporated into the website. With their help, the user is provided with an individual cookie, a small file is saved (instead of cookies, comparable technologies can also be used). The cookies can be set by different domains, including google.com, doubleclick.net, invitemedia.com, admeld.com, googlesyndication.com or googleadservices.com. In this file is noted which web pages the user visited, for what content he is interested and what offers he has clicked, as well as technical information about the browser and operating system, referring web pages, visit time and other information on the use of the online offer. The IP address of the users is also recorded, whereby in the context of Google Analytics we announce that the IP address is shortened within member states of the European Union or other parties to the Agreement on the European Economic Area and only in exceptional cases to one Google server in the US is transmitted and shortened there. The IP address will not be merged with data of the user within other offers from Google. The above information may also be linked by Google with such information from other sources. If the user then visits other websites, they can be displayed according to his interests, the ads tailored to him.
18.4 User data are processed as pseudonyms in the context of the Google marketing services. That Google stores and processes e.g. not the name or e-mail address of the users, but processes the relevant data cookie-related within pseudonymous user profiles. From the perspective of Google, the ads are not managed and displayed to a specifically identified person, but to the cookie owner, regardless of who that cookie owner is. This does not apply if a user has explicitly allowed Google to process the data without this pseudonymization. The information collected about users through Google Marketing Services is transmitted to Google and stored on Google’s servers in the United States.
18.5 Among the Google marketing services we use is u.a. the online advertising program “Google AdWords”. In the case of Google AdWords, each advertiser receives a different “conversion cookie”. Cookies can not be tracked through AdWords advertisers’ websites. The information collected through the cookie is used to generate conversion statistics for AdWords advertisers who have opted for conversion tracking. Advertisers will see the total number of users who clicked on their ad and were redirected to a conversion tracking tag page. However, they do not receive information that personally identifies users.
18.6 Also may use the service “Google Optimizer”. Google Optimizer allows us to understand how various changes to a website (such as changes to the input fields, the design, etc.) can take place in so-called “A / B testing”. Cookies are stored on users’ devices for these purposes. Only pseudonymous data of the users are processed.
18.7 In addition, we may use “Google Tag Manager” to integrate and manage the Google Analytics and Marketing Services on our website.

19. Facebook, Custom Audiences and Facebook Marketing Services
19.1 Due to our legitimate interests in analysis, optimization and economic operation of our online offer and for these purposes, we may use the so-called “Facebook pixel” of the social network Facebook, by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or, if you are located in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland (“Facebook”).
19.2 Facebook is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European data protection law (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).
19.3 With the help of the Facebook pixel, it is on the one hand possible for Facebook to determine the visitors to our online offer as a target group for the display of advertisements (so-called “Facebook ads”). Accordingly, we may use the Facebook Pixel to display Facebook ads only sent to those Facebook users who have shown an interest in our online offer or who have certain features (e.g. interests in certain topics or products that were visited by them), which we transmit to Facebook (so-called “Custom Audiences”). With the help of the Facebook pixel, we also want to make sure that our Facebook ads are in line with the potential interest of users and are not annoying. 19.5 You may object to the use of Facebook Pixel and use of your data to display Facebook Ads. To set which types of ads you see within Facebook, you can go to the page set up by Facebook and follow the instructions for the usage-based advertising settings: https://www.facebook.com/settings?tab=ads. The settings are platform independent, i.e. they are adopted for all devices, such as desktop computers or mobile devices.

20. Facebook Social Plugins
20.1 Based on our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Article 6(1) GDPR, we may use social plugins (“plugins”) of the social network facebook.com, which is operated by Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbor, Dublin 2, Ireland (“Facebook”). The plugins can represent interaction elements or content (e.g. videos, graphics or text contributions) and can be recognized by one of the Facebook logos (white “f” on blue tile, the terms “Like”, “Like” or a “thumbs up” sign ) or are marked with the addition “Facebook Social Plugin”. 20.2 Facebook is certified under the Privacy Shield Agreement, which provides a guarantee to comply with European privacy legislation (https://www.privacyshield.gov/participant?id=a2zt0000000GnywAAC&status=Active).
20.3 When a user invokes a feature of this online offering that includes such a plugin, their device establishes a direct connection to the Facebook servers. The content of the plugin is transmitted by Facebook directly to the device of the user and incorporated by him into the online offer. In the process, user profiles can be created from the processed data. We therefore have no influence on the amount of data that Facebook collects with the help of this plugin and how Facebook informs users according to our knowledge.
20.4 By integrating the plugins, Facebook receives the information that a user has accessed the corresponding page of the online offer. If the user is logged in to Facebook, Facebook can assign the visit to his Facebook account. If users interact with the plugins, for example, tap the Like button or leave a comment, the information is transmitted from your device directly to Facebook and stored there. If a user is not a member of Facebook, there is still the possibility that Facebook will find out and save their IP address. According to Facebook, only an anonymous IP address is stored in Germany.

20.6 If a user is a Facebook member and does not want Facebook to collect data about him via this online offer and link it to his member data stored on Facebook, he must log out of Facebook and delete his cookies before using our online offer. 21. Jetpack (WordPress Stats)
21.1 Based on our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Article 6(1) GDPR), we may use the plugin Jetpack (here the subfunction “WordPress Stats”), which includes Automated Visitor Access Statistics Tool and Automattic, Inc., 132 Hawthorne Street, San Francisco, CA 94107, United States. Jetpack uses so-called “cookies”, text files that are stored on your computer and that allow an analysis of the use of the website.

The test and training concepts „Meister Cody – Talasia“ and „Meister Cody – Namagi“ (hereinafter referred to as „Meister Cody“) are offers from Meister Cody GmbH, Graf-Adolf-Str. 69, 40210 Düsseldorf, Germany (hereinafter referred to as „Meister Cody“). 2. Completion of Contract

5. How to Cancel
If you purchased Meister Cody in the Apple App Store, Google Play Store, Amazon App Store or Digistore24 (gift certificate) or any of our other partners, please contact the relevant contractual partner.
If you have accidentally purchased Meister Cody through our billing system (which is available only for Germany, Austria or Switzerland), you are entitled to request a refund within seven days of the accidental purchase. All other purchases for Meister Cody are final. Your right of withdrawal can expire according to § 356 Abs. 5 BGB for “digital contents”. “Digital content” means “data produced and made available in digital form” (§ 312f para. 3 BGB). If you have problems accessing, using or downloading the application after purchasing via invoice, please contact us.
When you accept these terms and conditions, you expressly agree to the execution of the contract before the expiration of the revocation period. You agree that your right of revocation expires with the beginning of the execution of the contract. If you have any further questions, please contact us.

2. Vertragsschluss und Registrierung
Meister Cody steht als Anwendung für Windows und MacOS PCs sowie für Android, Fire OS und iOS Geräte zur Verfügung. Voraussetzung für die Nutzung von Meister Cody ist der Abschluss eines Nutzungsvertrages notwendig, der Nutzungsvertrag kommt mit der Registrierung in der App zustande. 3. Benutzung der App
Nach der Registrierung haben Sie die Möglichkeit, beliebig viele Testprofile anzulegen. Mit jedem Testprofil können Sie umgehend sowohl den CODY-M 2-4 als auch den CODY-LM Test absolvieren.
4. Testergebnisse
Das Testergebnis für den CODY-LM Test bekommen Sie nach Abschluss des Tests umgehend und kostenlos in der Anwendung/App angezeigt. Für die Auswertung des CODY-M 2-4 Tests benötigen Sie einen Gutscheincode, welchen Sie hier erwerben können. Den Gutscheincode geben Sie in der Anwendung/App ein, dafür wird Ihnen die im Gutschein hinterlegte Anzahl von Testauswertungen freigeschaltet. Pro Testergebnis des CODY-M 2-4 Tests wird eine Testauswertung abgezogen und daraufhin umgehend als Ergebnis in der Anwendung/App angezeigt. Sie haben zusätzlich dann die Möglichkeit, das Testergebnis als PDF-Dokument herunterzuladen.
5. Widerrufsbelehrung
Für einen Widerruf gelten die jeweiligen Bedingungen des Verkäufers der Gutscheincodes. Bitte wenden Sie sich an den entsprechenden Vertragspartner

Die Ersatzpflicht ist bei der Verletzung von wesentlichen Vertragspflichten jeweils auf den vorhersehbaren Schaden beschränkt.
Vorstehende Haftungsausschlüsse bzw. -beschränkungen gelten auch im Hinblick auf die Haftung der Angestellten, Arbeitnehmer, Mitarbeiter, Vertreter und Erfüllungsgehilfen der Meister Cody, insbesondere zugunsten der Anteilseigner, Mitarbeiter, Vertreter, Organe und deren Mitgliedern betreffend ihrer persönlichen Haftung.

„Meister Cody – Talasia“ und „Meister Cody – Namagi“ stehen als App für Android, Fire OS und iOS Geräte zur Verfügung. Der Schulbereich steht als Webseite unter https://schule.meistercody.com/ zur Verfügung. Die eigentliche Nutzung von Meister Cody durch Ihre Kinder erfolgt weiterhin auf mobilen Geräten (Tablets, Smartphones). Voraussetzung für die Nutzung von Meister Cody ist der Abschluss eines Nutzungsvertrages. Der Nutzungsvertrag kommt mit der Übersendung des unterschriebenen und mit Firmenstempel versehenen Angebotes an Meister Cody zustande. Das Angebot fasst den von Ihnen gewünschten Funktionsumfang (Optionen: Namagi (Deutsch) und/oder Talasia (Mathe), Nutzung von Meister Cody in der Schule und/oder zuhause) zusammen. Meister Cody erstellt im Anschluss ein Benutzerkonto, für dass Sie selbst ein Passwort setzen und vor der erstmaligen Nutzung diese AGBs und unsere Datenschutzerklärung akzeptieren. Bitte haben Sie Verständnis dafür, dass Sie Meister Cody ohne Registrierung nicht benutzen können.
3. Kostenlos unverbindliche Testzeit
Zum Kennenlernen stellen wir Ihnen den Schulbereich gerne in einer Live-Demonstration vor und richten Ihnen einen Testzugang zum Ausprobieren ein. Um Meister Cody nach Ablauf des Testzugangs weiter vollumfänglich nutzen zu können, müssen Sie einen kostenpflichtigen Zugang erwerben. Die Gültigkeit des Testzugangs stimmen wir indivduell mit Ihnen ab.
Sie können Meister Cody – Talasia und Meister Cody – Namagi im Testzeitraum, welcher im Moment die ersten 4 Trainingstage umfasst, vollumfänglich kostenlos nutzen.
4. Nutzung von Meister Cody nach Ende des Testzeitraums
Sollten Sie sich nach dem Ende des Testzeitraums entscheiden, Meister Cody weiter einzusetzen, dann erfolgt die Buchung grundsätzlich für einen Zeitraum von 12 Monaten.
Nach Vertragsabschluss senden wir Ihnen eine auf dem unterschriebenen Angebot basierende Rechnung zu, die im Anschluss zu begleichen ist.
5. Verlängerung und Beendigung der Nutzung
Ihre Buchung verlängert sich automatisch um weitere 12 Monate es sei denn, Sie kündigen die weitere Nutzung bis spätestens 2 Monate vor Ablauf des zuvor gebuchten Zeitraums. Die Kündigung kann schriftlich per Brief, Fax oder auch per E-Mail erfolgen.
Der Trainingsstand Ihrer Kinder bleibt immer solange erhalten, bis Sie uns mitteilen, dass wir die Daten löschen sollen.
6. Veränderung der Preispolitik
Unsere Preise können sich in Zukunft ändern. Sollte sich der Preis bei automatischer Verlängerung von dem der vorherigen Buchung unterscheiden, so werden wir Sie darüber im Vorfeld informieren.
7. Benutzung der Schulbereich
Nach der Registrierung und Einrichtung Ihres Zugangs haben Sie die Möglichkeit, Kinder anzulegen. Falls bei einem Kind besonderer Förderbedarf bestehen sollte, können Sie einen individuellen Trainingsfokus setzen. Unsere Abenteuergeschichte, die Kinder zum Trainieren motiviert, kann optional an- und abgeschaltet werden. Behalten Sie den Überblick darüber, ob ein Kind trainiert hat und wie die Ergebnisse aussehen. Der CODY-M 2-4 Dyskalkulietest kann optional an- und abgeschaltet werden. Aktivieren Sie, wenn diese Option Bestandteil Ihrer Buchung ist, die für Eltern kostenlose Nutzung des Trainings auf Privatgeräten.
8. Testergebnisse
Das Testergebnis für den CODY-M 2-4 bekommen Sie nach Abschluss des Tests umgehend im Schulbereich angezeigt. Er definiert den Themenschwerpunkt des Trainings und sorgt für Transparenz. Sie haben zusätzlich dann die Möglichkeit, das Testergebnis als PDF-Dokument herunterzuladen.
9. Sperrung und sonstige Maßnahmen
Meister Cody kann folgende Maßnahmen ergreifen, wenn konkrete Anhaltspunkte dafür bestehen, dass der Kunde gesetzliche Vorschriften, Rechte Dritter oder diese AGB verletzt, oder wenn Meister Cody ein sonstiges berechtigtes Interesse hat:
- Verwarnung des Kunden
- Be-/Einschränkung der Nutzung von Meister Cody
- Löschen von Inhalten des Kunden
- Sperrung des Zugangs des Kunden
Bei der Wahl der Maßnahme berücksichtigt Meister Cody die berechtigten Interessen des Kunden, insbesondere ob Anhaltspunkte dafür vorliegen, dass der Kunde den Verstoß nicht verschuldet hat.
9.1 Meister Cody ist insbesondere dann zur Sperrung des Zugangs des Kunden berechtigt, wenn
- der Kunde in erheblichem Maße seine vertraglichen Pflichten verletzt.
- eine Sperrung gerichtlich oder behördlich angeordnet wird; die Dauer der Sperrung hängt von der Dauer der gerichtlichen oder behördlichen Anordnung ab.
- der Kunde mit der Begleichung von Forderungen der Meister Cody in Verzug kommt.
9.2 Eine Sperrung des Zugangs entbindet den Kunden nicht von seiner Verpflichtung zur Zahlung der vereinbarten Entgelte.
9.3 Das Recht zur außerordentlichen Kündigung aus wichtigem Grund bleibt unberührt. Als wichtiger Grund gilt insbesondere:
- der schuldhafte Verstoß gegen wesentliche Bestimmungen oder Bedingungen dieses Vertrages durch die jeweils andere Partei, insbesondere wenn die andere Partei trotz schriftlicher Abmahnung weiterhin ihre Pflichten verletzt;
- die Sperrung des Zugangs aus den oben genannten Gründen;
- die Eröffnung des Insolvenzverfahrens über das Vermögen des Kunden oder die Ablehnung mangels Masse;
- die Abgabe einer eidesstattlichen Versicherung zum Vermögensverzeichnis durch den Kunden.
10. Leistungsumfang
Wir versuchen die größtmögliche Erreichbarkeit von Meister Cody sicherzustellen. Hiervon ausgenommen sind Zeiten, in denen die Server von Meister Cody aufgrund von technischen oder sonstigen Problemen, die nicht im Einflussbereich der Meister Cody liegen (höhere Gewalt, Verschulden Dritter usw.), über das Internet nicht zu erreichen sind, sowie Zeiten, in denen routinemäßige Wartungsarbeiten durchgeführt werden.
11. Urheberrechte

Sämtliche Texte, Bilder, Grafiken, Animations- und Sounddateien unterliegen dem Urheberrecht und anderen Gesetzen zum Schutz des geistigen Eigentums. Sie, sowie der Inhalt der Webseiten, dürfen weder für gewerbliche oder kommerzielle Zwecke noch zur Weitergabe kopiert, verändert und auf anderen Webseiten verwendet werden.
12. Haftung
Meister Cody haftet nicht für andere als grob fahrlässig oder vorsätzlich verursachte Schäden. Dies gilt jedoch nicht für die Haftung bei Verletzung von Leben, Körper und Gesundheit.
Bei leichter Fahrlässigkeit haftet Meister Cody nur im Falle der Verletzung von wesentlichen Vertragspflichten oder der Verletzung einer Garantie. Unter wesentlichen Vertragspflichten sind solche Pflichten zu verstehen, die die ordnungsgemäße Durchführung des Vertrags erst ermöglichen und auf deren Erfüllung der Nutzer vertrauen darf.
Die Haftung von Meister Cody nach dem Produkthaftungsgesetz bleibt unberührt.
Die Ersatzpflicht ist bei der Verletzung von wesentlichen Vertragspflichten jeweils auf den vorhersehbaren Schaden beschränkt.
Vorstehende Haftungsausschlüsse bzw. -beschränkungen gelten auch im Hinblick auf die Haftung der Angestellten, Arbeitnehmer, Mitarbeiter, Vertreter und Erfüllungsgehilfen der Meister Cody, insbesondere zugunsten der Anteilseigner, Mitarbeiter, Vertreter, Organe und deren Mitgliedern betreffend ihrer persönlichen Haftung.
Meister Cody haftet für Beratung nur, soweit die Fragestellung den Inhalt des Angebots betroffen hat.
Meister Cody distanziert sich ausdrücklich von den Inhalten sämtlicher Seiten, auf die direkte oder indirekte Verweise (sog. “Links”) aus dem Angebot der Meister Cody bestehen. Meister Cody übernimmt für diese Inhalte und Seiten keinerlei Haftung. Für die Inhalte dieser Seiten sind die Anbieter der jeweiligen Seiten selbst verantwortlich.
13. Schlussbestimmungen
Sollten Bestimmungen dieser Allgemeinen Geschäftsbedingungen oder des Vertrags unwirksam sein oder werden, so berührt dies die Wirksamkeit der übrigen Bestimmungen nicht.
Es gilt ausschließlich deutsches Recht unter Ausschluss der Bestimmungen zum einheitlichen UN-Kaufrecht über den Kauf beweglicher Sachen.
Gerichtsstand ist Düsseldorf.

Die Teilnahme an Gewinnspielen der Kaasa health GmbH setzt die Zustimmung zu den Teilnahmebedingungen voraus. Mit der Teilnahme an einem Gewinnspiel der Kaasa health GmbH akzeptiert der Teilnehmer diese Teilnahmebedingungen. Die Kaasa health GmbH behält sich das Recht vor, Teilnehmer von Gewinnspielen auszuschließen, sobald diese gegen die Teilnahmebedingungen verstoßen.
Teilnehmer, die sich durch Manipulation einen Vorteil verschaffen wollen, werden von der Teilnahme ausgeschlossen. Gegebenenfalls wird der Gewinn nachträglich aberkannt und zurückgefordert. Ausgeschlossen wird auch, wer unwahre Angaben zu seiner Person macht.
Teilnahmeberechtigt sind ausschließlich volljährige Personen mit einem ständigen Wohnsitz in Deutschland, Österreich und der Schweiz. Nicht teilnahmeberechtigt am Gewinnspiel sind alle an der Konzeption und Umsetzung der Gewinnspiele beteiligten Personen und Mitarbeiter der Kaasa health GmbH sowie ihre Familienmitglieder.
Die Teilnahme an Gewinnspielen der Kaasa health GmbH ist kostenlos und es besteht kein Kaufzwang.
Gewinner von Gewinnspielen der Kaasa health GmbH werden durch Zufallsziehungen ermittelt. Sie werden innerhalb von 3 Tagen nach Beendigung des Gewinnspiels benachrichtigt und haben 7 Tage Zeit, der Kaasa health GmbH ihre erforderlichen Daten mitzuteilen. Erhält die Kaasa health GmbH binnen 7 Tagen nach Kontaktaufnahme die erforderlichen Daten nicht, wird ein neuer Gewinner ermittelt. Ist auch dieser innerhalb von einer Woche nicht zu erreichen, verfällt der Preis endgültig.
Die Kaasa health GmbH behält sich das Recht vor, Gewinnspiele zu jedem Zeitpunkt ohne Vorankündigung zu beenden, wenn aus technischen oder rechtlichen Gründen eine ordnungsgemäße Durchführung nicht gewährleistet werden kann.
Sollten einzelne Bestimmungen der Teilnahmebedingungen ungültig sein oder ungültig werden, bleibt die Gültigkeit der übrigen Teilnahmebedingungen unberührt. An ihre Stelle tritt eine angemessene Regelung, die dem Zweck der unwirksamen Bestimmung am ehesten entspricht.
Gewinne sind vom Umtausch ausgeschlossen. Die Gewinne sind nicht auf Dritte übertragbar. Barauszahlungen von Gewinnen sind nicht möglich.
Gewinnspiele, die auf der Facebook-Seite von Meister Cody gepostet werden, werden in keiner Weise von Facebook gesponsert, unterstützt oder organisiert.
Der Rechtsweg ist ausgeschlossen.
